By using californiadaycares.com ("the Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site.

2. Description of Service

California Daycares is a directory of licensed childcare facilities in California. We compile publicly available data from the California Community Care Licensing Division (CCLD) and supplement it with user-generated content such as reviews, photos, and facility owner updates.

We are not a licensing authority. The information on this site is provided for informational purposes only. Always verify facility licensing status directly with the CCLD before making childcare decisions.

3. User Accounts

• You must provide accurate information when creating an account
• You are responsible for all activity under your account
• You may not create accounts for others without their permission
• We may suspend or terminate accounts that violate these terms

4. User-Generated Content

When you submit reviews, messages, photos, or other content:

• You retain ownership of your content
• You grant us a non-exclusive, worldwide license to display and distribute it on the Site
• You affirm that your content is truthful and does not violate any laws
• We reserve the right to moderate, edit, or remove content that violates our guidelines

5. Review Guidelines

Reviews must be based on genuine personal experience with the facility. The following are prohibited:

• Fake or incentivized reviews
• Reviews from facility owners about their own facility
• Harassment, threats, or personal attacks
• Discriminatory language
• Content unrelated to the facility or childcare experience
• Sharing personal information about children, staff, or other families

All reviews are moderated before publication. Editing a review sends it back for re-moderation.

6. Facility Claims

Facility owners may claim their listing by providing verification (license number, phone verification, or supporting documents). Claims are reviewed manually by our team. Submitting fraudulent claims may result in account termination.

7. Premium Subscriptions

Facility owners may purchase premium subscriptions (Gold or Platinum) for enhanced features. Subscriptions are billed monthly through Stripe. You may cancel at any time through your billing settings. Refunds are handled according to Stripe's policies.

Premium features include enhanced visibility, analytics, photo galleries, and contact forms. Premium status does not influence the accuracy of facility data sourced from CCLD.

7.5 SMS/Text Messaging Terms

Program Name: California Daycares SMS Alerts

Program Description: By opting in to California Daycares text messages, you agree to receive recurring automated SMS messages related to our marketing and digital services for daycare business owners. Message types include:

• Promotional offers and discounts on our services
• Account notifications and listing updates
• Appointment and consultation reminders
• Service announcements

Opt-In: You may opt in to receive text messages by checking the SMS consent box during account registration on californiadaycares.com, or by texting START or SUBSCRIBE to our designated phone number. Opting in is not required to use our platform or purchase our services.

Message Frequency: Message frequency varies based on your account activity and ongoing promotions. You may receive up to 10 messages per month.

Message and Data Rates: Message and data rates may apply. Check with your mobile carrier for details about your plan.

Opt-Out: You may opt out at any time by replying STOP to any text message you receive from us. You will receive a single confirmation message after opting out. No additional messages will be sent unless you opt back in.

Supported Carriers: Major US carriers are supported. Carriers are not liable for delayed or undelivered messages.

8. Prohibited Uses

You may not:

• Scrape, crawl, or systematically download data from the Site beyond normal browsing
• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Impersonate another person or facility
• Interfere with or disrupt the Site's operation
• Use automated tools to submit reviews, claims, or messages

9. Disclaimer of Warranties

The Site is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of facility data. CCLD data is updated periodically and may not reflect the most current status of a facility.

We are not responsible for the quality of care at any listed facility. Parents should independently verify all information and visit facilities in person before enrolling their children.

10. Limitation of Liability

To the maximum extent permitted by law, California Daycares shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, including but not limited to decisions made based on facility information displayed on the Site.

11. Changes to Terms

We may update these terms at any time. Continued use of the Site after changes constitutes acceptance of the new terms.
